I recently sold an ATV on ebay and finally received down payment into my PayPal account.  However, the  buyer on three occasions has not picked up the ATV as he promised.  Nor have I seen a bank check for the balance.  I can email hin and phone him but he no longer answers.  The partial payment was received from a hotmail email address which I've emailed, but the email was undeliverable because no such mailbox exists, yet I did receive the payment.  I think the buyer is a middleman for someone in Europe, and that person paid.   The ATV is just sitting here.  I need to get this resolved.  What should I do?

Sounds like a breach of contract ... legally that down payment belongs to you now.  The buyer has defaulted on the purchase and no longer has a right to claims.  But, You might want to check the seller's policy on eBay just to see what they say so you don't get a bad rating by accident.

Ohh ... since there is a "European connection" mixed up in all this:  if the buyer does show up with a check or money order to pay the balance...don't deliver the goods until the check clears.  Otherwise you might end up with no ATV and no Euros!

"Europe", "Middleman"? Loren is right about the check. Almost certain to be a counterfeit.
This has all the signs of a 419.
Hang on to that "down payment": it may have come from a stolen CC, or hacked Paypal account, and PayPal will soon be taking an interest in the matter.

Again, excellent advice. Check e-bay's policy on defaulted purchase - and maybe put them in the loop - before re-posting the item for sale.

Yeah  they are right...   I have been doing ebay for several years, and there are plenty of scams.  I don't suppose the sender of the payment was "verified" with paypal??  Personally, I would contact paypal and ebay trust and safety.  I had a fraudulent claim just last week.  I contacted both ebay and paypal, and they were able to resolve it fairly quickly for me. 

Good luck!!  It seems ebay is having more and more problems like this.  Its a shame we all have to be suspicious of each other because there are so many scam artists....Let us know how this turns out for you!
