1. ELIGIBILITY:
Nominators and Nominees must be legal residents of the 50 United States or the District of Columbia.
Nominators must be 13 years of age or older at the time the nomination is made.
Nominees must be between 13 to 17 years old as of October 25, 2007.
Nominees must be a registered AAU athlete. Employees of Sponsor, its parent, and their subsidiaries, advertising and promotion agencies, judges, participating retailers and the immediate family members (parents, stepparents, children, stepchildren, siblings and spouse) and/or those living in the same household of each are not eligible to be nominated.
2. HOW TO ENTER: To nominate someone for the Dr Pepper AAU Spotlight Athlete, complete an official nomination form at
http://www.DrPepper.com/AAUSpotlightAthlete during the Entry Period. Fill out the nomination form with all information requested, including a
merit essay of 500 characters or less typed in English in your own words explaining why a particular teenager ("Nominee") between the ages of 13 and 17 (as of October 25, 2007) and an AAU registered athlete you know has excelled in leadership and advocacy, community service, extra curricular involvement and overall moral character.
Please provide details that explain how a particular nominee has demonstrated each of the aforementioned criteria. DO NOT INCLUDE ANY PERSONÕS (OTHER THAN NOMINEE'S) FULL NAME OR OTHER PERSONAL INFORMATION, OR ANY TRADEMARKS, OR OTHER INTELLECTUAL PROPERTY OF THIRD PARTY'S IN THE ESSAY. ,. Enter online at the Site by filling out the official nomination form, including the required merit essay. Entries must include the following: nominatorÕs name ("Nominator"), complete address, date of birth, daytime and home telephone numbers with area code, relationship to nominee, and e-mail address, and the NomineeÕs name, address, daytime and home telephone numbers with area code, sport and position played, parents/guardiansÕ names, parents/guardiansÕ phone numbers, parent/guardiansÕ email addresses, merit essay, and NomineeÕs date of birth and a valid e-mail address. All submissions become the exclusive property of Sponsor and will not be returned.
JUDGING: An independent qualified panel of judges, whose decisions are final and binding on all matters relating to this contest, will judge all eligible entries received each month to select finalist Nominees ("Spotlight Athlete"). A total of ten (10) Spotlight Athletes will be selected. Nominees that are not chosen as a Spotlight Athlete will not be considered for subsequent months. All nominees will be judged based on the following criteria: leadership and advocacy (40%), community service (20%), and extra curricular involvement (20%), and overall moral character (20%). In the event of a tie, tie breaker will be based upon the highest score in the first judging criteria, continuing thereafter to each judging criteria in order, as needed, to break the tie. Sponsor will contact the ten (10) potential Nominee Finalists by phone or email in order to obtain a brief biography and photos of the potential Nominee Finalist (as outlined below), as well as a required signed liability/publicity release from potential Nominee Finalist's parent or legal guardian authorizing use of the potential Nominee Finalist's name and other personal information contained in the essay to be posted on the internet and otherwise used for advertising and promotional purposes. Failure to return such signed liability/publicity release within the timeframe set forth by Sponsor shall result in disqualification of potential Nominee Finalist. The Nominee Finalist's essays will be displayed on the promotional minisite from on a monthly basis, one each from March 1, 2007 Š December 1, 2007.
Photo requirements: All Nominee Finalists will be asked to submit a high-resolution color photo in .jpg or .gif format of 300 dpi. File size should be no larger than 400K. The photo should be a photo of the Nominee Finalist involved in the activity for which theyÕve been nominated. No other identifiable third party may be contained in such photo. All photos submitted will become the property of Sponsor and will not be returned. The winner may be asked to provide Sponsor with an original negative (if available) of the photo submitted for use in the development of the print article. A second panel of independent judges will review all Nominee Finalist's essays and select one (1) potential Nominee winner on or about December 7, 2007 based on the same criteria outlined above. The potential Nominee winner will be contacted by phone on, or around, December 14, 2007, and the Nominee's parent or legal guardian will be required to sign, have notarized and return an unmodified Affidavit of Eligibility and Liability/Publicity release form within seven (7) days of issuance in order for potential Nominee to be verified and receive the prize.
5. DISQUALIFICATION / INELIGIBILITY: Without limiting any other provision of these Rules, Sponsor reserves the right, at any time and in its sole discretion, to disqualify and/or deem ineligible to participate in this Contest or any future Sponsor contests or other promotions, any individual it suspects: to be tampering with the entry process or the operation of the Contest or Site; to be in violation of the SiteÕs Privacy Policy (
http://www.drpepper.com/privacy.cfm) or other terms, conditions or guidelines; to have failed to agree to these Rules; to be in violation of these Rules; to be acting in bad faith, or in a non-sportsmanlike or disruptive manner; or to be annoying, abusing, threatening, or harassing any other person in connection with the Contest or the Site. Furthermore, Sponsor reserves the right, in its sole and absolute discretion, to disregard and/or deem VOID any or all such entrantÕs entries in the Contest. ANY ATTEMPT TO DAMAGE THE SITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF THESE RULES AS WELL AS CRIMINAL AND CIVIL LAWS. PRIZE: (1) Grand Prize will be awarded to the winning Nominee, consisting of a $1,000.00 Savings Bond to use as a scholarship to an accredited college, junior college or university for the winning Nominee and an announcement page on the minisite from about January 1, 2008 through January 31, 2008. No prize will be awarded to Nominator. Prize is not transferable and no substitutions allowed. No cash redemption of prize. If prize or prize notification is returned as undeliverable or winner cannot be contacted for any reason, or winner's parent or legal guardian does not return the required documentation, the prize may be forfeited and awarded to an alternate. Nominator shall not receive any compensation for use of entries.
DETAILS: Each Nominator represents that the essay and photograph submitted is the NominatorÕs or Nominee's, as applicable, original creation, has never been published, has not previously won any other contest award, does not infringe third party rights (including those of any photographer), and are suitable for publication and the right to submit it is not restricted. Nomination submission and photo cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights, including trademarks. No mechanically reproduced, illegible, incoherent, unusable, or incomplete entries will be accepted. Sponsor is not responsible for typographical errors or any other errors submitted by entrants. Nominations not complying with all rules are subject to disqualification. No correspondence regarding nominations will be entered into with Nominators or Nominees. With respect to submissions (essay and photo), Nominator and Nominee unconditionally assign and transfer to Sponsor all rights, title, interest and claim, which thereafter including, without limitation, the copyright therein. Sponsor shall have right to use, alter, assign or dispose of such submissions however it sees fit without approval of entrants. By submitting, Nominators and Nominees agree that they have no right to bring (and covenant not to bring) any claim, action, or proceeding of any kind or nature whatsoever against Sponsor or its affiliated companies, subsidiaries, agents, employees, or shareholders in connection with this Contest. In order to post the essay and photograph on the Site, Nominee will be required to sign documentation confirming that the Sponsor has the right to use NomineeÕs name, image, likeness, voice and biographical materials, as well as Nominator's submission for advertising, publicity and promotion purposes including without limitation announcements without additional compensation, unless prohibited by law.
