1. ELIGIBILITY: To be eligible to receive exclusive discounts in the Papa John's TEXTra Points 4 Pizza Promotion (the "Promotion"), entrants must be 13 years of age or older as of Jan. 3, 2008 (if the age of majority in your jurisdiction is different than 13, you must be the age of majority within your jurisdiction) and a legal resident of the 48 contiguous states or the District of Columbia ("Entrants"). By registering to play, Entrants agree to be bound by all of the terms and conditions of these Official Rules and Regulations (the "Official Rules”). By registering to play, Entrants also agree to be bound by all of the terms and conditions of the Promotion Rules and Documentation (the "Rules") applicable to the Promotion as provided by Papa John's (PJ). PAPA JOHN'S reserves the right to make non-material changes to these Official Rules at any time during the Promotion. The Promotion is not to be used in connection with any form of gambling or the promotion of gambling.
2. TIME PERIOD: Registration for the Promotion will begin on or about Jan. 4, 2008 and end at 5:59 p.m. EST Feb. 3, 2007. The Promotion and participation in the Promotion are subject to the Official Rules, and all applicable federal, state and local laws. All entries become the property of PAPA JOHN'S. As set forth in section 8 below, PAPA JOHN'S reserves the right to limit the number of entries in the Promotion at any time and for any reason. 3. TO ENTER: To enter the Promotion, Entrants must register by texting "POINTS" to 47272 (4PAPA) or registering to receive text messages from Papa John's at www.papajohns.com prior to the professional football games on Jan. 5/6, 2008; Jan. 12/13, 2008; Jan. 20, 2008; and Feb. 3, 2008 (no cost involved).
Only (1) entry per length of the Promotion is necessary to play. Promotion Entrants will be notified via text message of the receipt of their entry and must redeem the promo code online at www.papajohns.com.

For the wild card and divisional rounds of the professional football playoffs (Jan. 5/6, 12/13), if the score of any game totals 25 points or more, Promotion Entrants will receive a text message with an exclusive promo code worth 25 percent off the average national regular menu price of a large, three-topping pizza ordered online the following week. This will allow the Entrant to purchase a large, three-topping pizza with a national average regular menu price of $15.99 for only $11.99.
For the conference championship round (Jan. 20, 2008), if the score of any game totals 50 points or more, Promotion Entrants will receive a text message with an exclusive promo code worth 50 percent off the average national regular menu price of a large, three-topping pizza ordered online the following week. This will allow the Entrant to purchase a large, three-topping pizza with a national average regular menu price of $15.99 for only $7.99.For the Big Game (Feb. 3, 2008), if the cumulative score is 75 points or more, Promotion Entrants will receive a text message with an exclusive promo code worth 75 percent off the average national regular menu price of a large, three-topping pizza ordered online the following week. This will allow the Entrant to purchase a large, three-topping pizza with a national average regular menu price of $15.99 for only $3.99.Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the mobile telephone number used to register will be deemed to be the registrant or player. The potential winner may be required to show proof of being the authorized account holder. Approximate Retail Value ("ARV") of one large, three-topping Papa John's pizza, based on the average national regular menu price, is $15.99. The actual retail value of a large, one-topping Papa John's pizza varies among store locations.
5. DISCOUNT CONDITIONS: No transfers, alterations, substitutions or cash redemptions of the discounts will be permitted, except as provided herein.

All unclaimed prizes and prizes for which it is determined an Entrant is ineligible will be forfeited at the sole discretion of PAPA JOHN'S.
6. WINNER NOTIFICATION: All Promotion
Entrants will be notified via text message the Monday following each weekend game (Jan. 7, 2008; Jan. 14, 2008; Jan. 21, 2008; Feb. 4, 2008) at the mobile number supplied to Papa John's. A promotion code will be given for the Promotion Entrants to redeem at
www.papajohns.com or via text ordering for their discounted large, three-topping pizza during the following week.
7. LIMITATIONS OF LIABILITY: By registering for the Promotion, all participants release Papa John's and its respective parents, subsidiaries, directors, governors, stockholders, employees, representatives, sponsors and affiliates (collectively, "Released Parties") from and against any and all costs, expenses, liability, damages, claims or actions of any kind, including those related to injuries or damages to persons or property, arising out of or in connection with participation in the Promotion, receipt, ownership or use of any discount, the preparation for, participation in, or traveling to any discount-related activity or in connection with any claims based upon violation of publicity rights, defamation or invasion of privacy. Additionally, participants agree that the Released Parties shall not be responsible for a) lost, late, illegible, misdirected, mutilated, incomplete, returned email, or entries; b) any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with the Promotion or by any technical or human error that may occur in the processing of entries in the Promotion; c) any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, telephones, software, or hardware, failure of email on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Promotion; and d) any error, omission, interruption, deletion, defect, delay in operation or transmission, or the theft, destruction or alteration of entries or other materials. Papa John's may prohibit any Entrant from participating in this Promotion or any future promotion or refuse to award a discount or prizes to an Entrant if Papa John's determines in its sole discretion that such entrant (i) has tampered with the entry process or the operation of the Promotion or any Web site (including, without limitation, trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the Promotion computer programs and systems), (ii) has violated the Promotion Rules, or (iii) has acted (a) in an un-sportsmanlike manner, (b) with an intent to annoy, abuse, threaten, or harass Papa John's or any Entrant, (c) in an improper manner that is adverse to the operation of the Promotion or detrimental to another Entrant, or (d) in any other disruptive manner. The use of any automated entry device is prohibited. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, player strike or lock-out, or any other causes beyond the control of the Papa John's which corrupt the administration, security, fairness, integrity or proper conduct of the Promotion, Papa John's reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion and, at its discretion, award discounts from among all non-suspect, eligible participants and/or disqualify suspect entrants. In the event of a dispute as to the identity of any Promotion Entrant, the Promotion Entrant will be deemed to be the authorized account holder of the applicable email address at issue. 10. CHOICE OF LAW: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of the Promotion Rules or the rights and obligations of the entrants and Papa John's, in connection with the Promotion shall be governed by, and construed in accordance with the laws of the State of Kentucky. All Entrants consent to the jurisdiction and venue of the courts of the Commonwealth of Kentucky located within Jefferson County and the U.S. District Court for the Western District of Kentucky, Louisville Division.
