Timing:
The "Qantas Frequent Flyer A380 Inaugural Giveaway" (the "Promotion" or the "Sweepstakes") begins on Tuesday, 23 September 2008 at 12.01am Pacific Time (PT) and ends on Monday, 6 October 2008 at 11.59pm PT (the "Promotion Period").
Eligibility requirements:
Sweepstakes open to all legal residents of the fifty United States and Canada (excluding Quebec), who are at least twenty-one (21) years of age at the time of entry and who were enrolled in the Qantas Frequent Flyer Members Program as of 22 September 2008 at 12.01am PT. Employees of Qantas Airways Limited ("Qantas"), its affiliates, advertising & promotion agencies, as well as any other entity, or individual, directly associated with this promotion, and the immediate family members (spouse, parents, siblings and children) and/or household members of these entities, are not eligible to participate.

Each Qantas Frequent Flyer Member is limited to one entry during the Promotion Period. In case of dispute, Qantas will award the Prize to the Qantas Frequent Flyer Member whose account was used to make the entry. Automated entries are prohibited, and any use of such automated devices will cause disqualification. Qantas and its advertising/promotional agencies are not responsible for lost, late, illegible, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic.
Canadian entrants:
If the potential winner is a Canadian resident, he/she will be required to correctly answer a mathematical skill-testing question before being declared the winner.
Prizes:
There is one (1) Grand Prize of two (2) round-trip Economy Class Seats on the inaugural flight of the A380 from Los Angeles (LAX) to Melbourne, Australia. Approximate Retail Value of the Grand Prize is $4,000.
Prize conditions:
Prize includes two (2) Economy Class tickets valid for travel from Los Angeles (LAX) to Melbourne, Australia (Southbound) and Melbourne or Sydney, Australia to Los Angeles (LAX) (Northbound). This award is for travel on the Qantas A380 Inaugural Flight on 20 October 2008. Return segment will also be in Economy Class, but is not guaranteed to be on the A380 Aircraft. If you are unable to travel on this inaugural flight, you may travel during the periods shown below with an Economy Class ticket.
Terms and conditions:
Your air travel reservations are subject to the following conditions:
(a) Southbound and northbound travel must occur between 20 October 2008 and 31 October 2009, excluding the period from 11 December 2008 through 31 January 2009.
Keep in mind that certain travel periods are busier than others and it may be difficult to obtain seats.
(b) You and your companion must travel together on the same flights.
(c) All travel must be completed within 90 days from the date of ticket issuance, and no later than 31 October 2009.
(d) Travel is valid for the segments stated above only. Additional segments can be purchased through Qantas Reservations.
(e) Tickets are non-refundable and non-transferable.
(f) Travel is subject to schedule changes and may only be used on Qantas-operated services.
(g) This award is excluded from frequent flyer mileage credit or mileage redemption for upgrade and does not include carriage where Qantas has seat lease agreements with other airlines (travel not valid on codeshare flights).
(h) These tickets are not subject to any denied boarding policy.
(i) This certificate may not be sold to, bartered with, or purchased or utilized by a third party.
(j) Government and airport taxes are the travelers' responsibility (approximately US$350 per person).
(k) Winner and travel companion are responsible for obtaining all necessary travel documents and passports.
All expenses and costs not expressly listed above including, but not limited to, transportation to and from the Los Angeles airport, transportation in Australia, including transportation to and from the airports, hotel expenses, food and beverages, excursions, telephone calls, souvenirs, gratuities, and all taxes, are solely the winner's responsibility. All airline reservations for the winner will be made through Qantas. No substitution or transfer of Prize permitted, except that Qantas reserves the right to substitute a prize of equal or greater value in the event that the Prize is unavailable. There is no cash substitute for the Prize. Federal, state and local taxes are the responsibility of the winner. An IRS Form 1099-MISC will be issued to the winner for the Approximate Retail Value of the Prize.

Drawing and notification:
Winner of the Grand Prize will be determined in a random drawing from all eligible entries received. Drawing will be held on or about Tuesday, 7 October 2008 by US Sweepstakes & Fulfillment Co., an Independent Sweepstakes Administrator whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend on the number of entries received. Winner of the Sweepstakes will be notified by phone, e-mail or mail. If a potential winner cannot be reached within three (3) calendar days from the first notification attempt, then such person shall be disqualified and an alternate winner will be selected. Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within 7 days of notification date, or prize will be forfeited. The winner's guest will also be required to sign a liability release. Up to two alternate winners will be chosen before the prize will be considered unclaimed. If a final winner determination is determined after the 20 October 2008 Inaugural Flight, the winner may travel on another flight as stipulated in (a) of the Terms and Conditions above.
Limitation against liability:
Winners agree that (except where prohibited) Qantas may use their name, photo/likeness and voice for advertising and promotional purposes without further compensation. To the extent permitted by law, Qantas, its promotional and advertising agencies, and all respective officers directors, employees, representatives and agents shall have no liability and shall be held harmless by winner for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Sweepstakes. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees. Qantas reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes should virus, bugs, non-authorized human intervention or other causes beyond their reasonable control corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. In such event, Qantas may award the Prize in a random drawing from all eligible entries received up to the date of cancellation or suspension. Qantas and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, or incomplete, garbled or delayed computer transmissions, whether caused by Qantas, by users, by any of the equipment or programming associated with or utilized in the promotion, or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Qantas may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Qantas' representatives. Sweepstakes is subject to federal, state, and local laws.
CAUTION:
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, QANTAS RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
