EligibilityThe Cracker Barrel Road to the Holidays (the “Sweepstakes”) is open only to legal residents of the contiguous United States (i.e., excluding Alaska, Hawaii and U.S. territories) over the age of majority at time of entry in their jurisdiction of residence. • Opt-in to Receive Emails from Cracker Barrel: You will be awarded (25) entries if you sign up to receive email communications from Cracker Barrel through the Site.
• Mailing-In: Alternatively, you can receive entries by hand printing your name, age, complete address (including zip code), daytime phone number, email address, on a 3”x 5” card and mail it, postage prepaid, to Cracker Barrel Old Country Store® “Cracker Barrel Road to the Holidays” P.O. Box, 787, Lebanon, TN 37088. Upon receipt of such card, you will be awarded with (616) entries. Mail in entries must be postmarked by December 22, 2019 and received no later than December 29, 2019.

Multiple participants are not permitted to share the same email address. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. 5. Winner Selection Each day during the Sweepstakes Period there will be (10) daily prize winners.

On or about November 1, 2019 (for entries received on or before October 27, 2019) and January 6, 2020 (for entries received during the Sweepstakes Period) the Sponsor or an independent judging agency will select (1) entry for each prize described below in a random drawing of all valid entries received.

Selected entrants may be contacted using the email address or telephone number provided with the entry (as determined in Sponsor’s discretion) and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these Official Rules).

Potential winners will be notified approximately (1) day after the applicable drawing. Failure to respond to the initial verification contact within (5) days of notification or return of e-mail notification as undeliverable after (3) attempts may, in Cracker Barrel’s sole discretion, result in disqualification. Odds of winning the prize depend on the number of eligible entries received.

6. POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.

7. Verification of Potential Winners The potential prize winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential prize winner may be required to sign and return to Sponsor, within (2) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. Actual value of the Grand Prize may vary based on airfare fluctuations and distance between departure and destination. Grand Prize Winner will not receive the difference between actual value and ARV. Sponsor will determine airline, and flight itinerary in its sole discretion. If winner lives within 150 miles of New York, NY ground transportation might be provided. No refund or compensation will be made by Sponsor in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier, as detailed in the passenger ticket contracts. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of the Grand Prize Winner. Travel package does not include transportation to or from the location of air travel departure, gratuities, bar, and beverage charges or items of a personal nature. Prize Truck: To claim and take possession of the Prize Truck, Grand Prize winner must show proof of a valid driver’s license and insurance. Grand Prize winner is responsible for complying with all requirements related to registration, licensing and titling of the Prize Truck in prize winner’s state. Truck will be delivered within the contiguous United States to the Grand Prize winner. The Grand Prize winner will be responsible any taxes, title, insurance, license fees, and all other costs that are not expressly listed in the prize description and that are incurred in claiming, registering, taking possession of, or using the Prize Truck. Sponsor does not make and is not responsible or liable for any warranty, representation, or guarantee, whether express or implied, in fact or in law, relative to the Prize Car including but not limited to its quality, fitness for any purpose, or mechanical condition.

Notwithstanding anything in these Official Rules to the contrary:

THE PRIZE TRUCK AWARDED UNDER THIS SWEEPSTAKE IS PROVIDED “AS IS”. SPONSOR ASSUMES NO RESPONSIBILITY FOR REPAIRS TO THE PRIZE TRUCK BASED ON DEFECTS OR OTHERWISE. SPONSOR MAKES NO REPRESENTATIONS REGARDING THE QUALITY AND PERFORMANCE OF THE PRIZE TRUCK. SPONSOR: (1) WARRANTS ONLY THAT TITLE TO THE PRIZE TRUCK CONVEYED IS GOOD AND TRANSFER RIGHTFUL AND PROVIDES NO OTHER WARRANTIES WHATSOEVER WITH RESPECT TO THE PRIZE TRUCK; AND (2) TO THE FULLEST EXTENT PERMITTED BY LAW, EXPRESSLY DISCLAIMS ALL OTHER EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The Prize Truck will be released only upon presentation of valid driver’s license and satisfactory proof of insurance and any other documentation required by law.

For all Prizes: Prizes are non-assignable or transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No exchange or substitution of prizes, except at the sole discretion of the Sponsor. Any other incidental expenses associated with the receipt and/or use of prize is the winner’s sole responsibility. The winner is responsible for all federal, state and local taxes, if applicable. Publicity Except where prohibited, participation in the Sweepstakes constitutes winners consent to Sponsor’s and its agents use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for Sweepstakes purposes in any media, worldwide, without further payment or consideration.

11. General Conditions Sponsor and/or Administrator reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s and/or Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Limitations of Liability The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes.

13. Disputes Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Middle District of Tennessee or the appropriate Tennessee State Court located in Wilson County, Tennessee; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee.

15. Winner List Winner List requests will only be accepted after the Sweepstakes end date (listed above) and no later than March 1, 2019.
