2) ELIGIBILITY: The promotion is open to all legal residents of the continental United States and the District of Columbia, 18 years of age or older as of date of entry, except employees and immediate family members of the Sponsors, their affiliates, parent and related companies and their advertising and promotion agencies. Giveaway is subject to all Federal, state and local laws and regulations. Void outside the continental United States, the District of Columbia and where prohibited by law. All entrants agree to abide by these Official Rules.
3) Sponsors, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of the website, or anyone who is otherwise in violation of the Giveaway rules.
All entries become the property of the Sponsors and will not be acknowledged or returned. Sponsors reserve the right to cancel, terminate or modify any portion of the Giveaway, for any reason, without limitation. By submitting an entry form, you thereby agree that Releases shall not be liable for injuries, losses or damages of any kind resulting from participation in this Giveaway, acceptance of, use of, or misuse of the prize. 4) WINNER SELECTION: There will be five (5) winners each day, for 6 days, from October 17-22, 2014 and a grand prize winner on October 23, 2014.
5) PRIZE: The 30 daily winners from October 17 to October 22, 2014 will receive a pair of champagne flutes. The grand prize winner on October 23, 2014 will receive a $1000 Michael C. Fina Gift Card. Prizes may not be redeemed for cash. Acceptance of the Prizes constitutes consent to use the Winner's name and likeness for editorial, advertising, and publicity purposes, without further compensation, except where prohibited by law. All Federal, state and local taxes that may be applicable are the responsibility of the Winner. Odds of winning are determined by the total number of eligible entries received.
6) GENERAL: Entrants release and waive any and all claims they may have for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney's fees) resulting from acceptance, use, or misuse of the Prize or element thereof, or participation in this Giveaway. If for any reason this Giveaway is not capable of running as planned, or if this Giveaway or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Giveaway and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, technical failures, or any other causes, in the Sponsors' sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, modify, or suspend this Giveaway or any portion thereof. If such cancellation, modification, or suspension occurs, notification will be posted at the Entry Site. Any attempt by an entrant or any other individual to deliberately damage the entry site or undermine the legitimate operation of the Giveaway is a violation of criminal and/or civil laws and should such an attempt be made, the Sponsors reserve the right to seek damages and other remedies from any such person to the fullest extent permitted by law. All entries will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
7) Releases shall not be liable to Winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), war, fire, flood, or any other cause beyond Sponsors' sole control. Releases shall not be liable for any loss or damage at any time during the use of the prize.
