Now I am not a lawyer, and I am sure it is different for each state, that being said, in my state it is legal and done quite abit , They do this to make the wages meet minimum wage. It is not right and not fair. But when my daughter started working at a famous pizza place,(that will remain nameless, Initials P.H.) anyway when she started there as a waitress they told her she had to claim all her tips for taxes and list them on her check, they also flat out told her this was to make her $3.15 equal minimum wage, and they also stated that while if she did not make enough tips to equal minimum wage they would by law have to make up the difference, but that all employees where expected to be good enough to make enough tips to do this. In other words, if you don't we won't keep you. I did call the family Lawyer and ask, he said the tips taxed and counted toward minimum wage was legal, all though he also agreed, wrong.
